Do Personal Injury Cases Usually Go to Trial?

The short answer is no. The vast majority of personal injury & wrongful death lawsuits settle before the case ever reaches trial. In fact, about 95% of all claims are settled out of court.

Unfortunately though, most personal injury cases are settled for way less than their true value. Without leverage (i.e., an attorney willing to back your claims up with a lawsuit), negotiating a settlement with the insurance company is a one-sided battle.

Having an attorney on your side does not mean that your case will end up in a courtroom. In fact, it simply gives you a far greater chance at recovering the settlement you’re truly owed.
